By downloading, installing, or using RailShot TV ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

1. Description of Service

RailShot TV is a mobile application that enables users to livestream billiards matches to YouTube and Facebook. The App provides:

  • Professional scoreboard overlays with customizable styles
  • Live streaming functionality to YouTube and Facebook
  • Camera and audio capture for streaming
  • NDI camera support for advanced setups
  • Game score tracking and management

2. User Responsibilities

You are responsible for:

  • All content you stream using the App
  • Compliance with YouTube and Facebook's terms of service
  • Obtaining necessary permissions for any content you stream
  • Ensuring you have the right to stream any audio or video content
  • Maintaining the security of your YouTube and Facebook accounts

3. Prohibited Uses

You agree not to use the App to:

  • Stream illegal, harmful, or offensive content
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Harass, abuse, or harm others
  • Transmit viruses or malicious code
  • Attempt to reverse engineer or modify the App

4. Third-Party Services

The App integrates with third-party services:

  • YouTube: Your use of YouTube is subject to YouTube's Terms of Service. We are not responsible for YouTube's services or policies.
  • Facebook: Your use of Facebook is subject to Facebook's Terms of Service. We are not responsible for Facebook's services or policies.
  • NDI SDK: The App uses the NDI SDK for camera discovery. NDI is a third-party technology.

We are not responsible for the availability, accuracy, or content of third-party services.

5. Intellectual Property

The App and its content, including but not limited to:

  • Software code and design
  • Scoreboard designs and graphics
  • User interface elements
  • Trademarks and logos

are owned by RailShot TV and protected by copyright and trademark laws. You may not copy, modify, or distribute the App without permission.

6. User Content

You retain ownership of any content you stream using the App. However, by using the App, you:

  • Grant us a license to use your content solely for providing the App's services
  • Represent that you have the right to stream such content
  • Agree that we are not responsible for your content

Content is streamed directly to your chosen platform (YouTube or Facebook). We do not store or host your content.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability of the App

We do not guarantee that the App will be uninterrupted, error-free, or secure.

8. Limitation of Liability

To the maximum extent permitted by law, RailShot TV shall not be liable for:

  • Any indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Service interruptions or failures
  • Issues with third-party services (YouTube, Facebook)

Our total liability shall not exceed the amount you paid for the App, if any.

9. Indemnification

You agree to indemnify and hold harmless RailShot TV, its owners, employees, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App or violation of these Terms.

10. Termination

We reserve the right to:

  • Terminate or suspend your access to the App at any time
  • Modify or discontinue the App without notice
  • Remove or edit content at our discretion

You may stop using the App at any time by uninstalling it from your device.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RailShot TV operates, without regard to its conflict of law provisions.

14. Acceptance
